Applicability of rules to unauthorized operators

Normally, Part 121 governs scheduled air carriers and commercial operators who hold proper certificates and operations specifications under Part 119. However, if someone conducts operations that require Part 121 certification but operates without the required authority, they're still bound by all Part 121 rules.
In practical terms, this prevents operators from claiming they don't need to follow Part 121 safety requirements simply because they lack proper certification. An unauthorized operator can't argue "these rules don't apply to me because I'm not certificated." This regulation closes that loophole and ensures the FAA can enforce Part 121 standards against anyone conducting Part 121-type operations, regardless of their certification status. It's primarily an enforcement tool that protects the flying public from uncertificated operators who might otherwise claim exemption from safety regulations.
