Passenger information requirements and smoking prohibitions

This regulation governs smoking restrictions and passenger information requirements for Part 135 operations.

On flights where smoking is prohibited by DOT rules (Part 252), operators must keep "No Smoking" signs illuminated or post placards throughout the flight. No one may smoke when these signs or placards are displayed.

Limited exceptions exist for flight deck smoking (if physically separated from passengers):

  • On certain intrastate commuter and on-demand flights using smaller or non-turbojet aircraft, pilots may authorize flight deck smoking except during surface movement, takeoff, and landing
  • On other on-demand operations, flight deck smoking may be permitted with more restrictions

Smoking is always prohibited in lavatories. Aircraft with lavatory smoke detectors must post tampering penalty warnings, and tampering with detectors is forbidden.

On flights not covered by Part 252 smoking bans, "No Smoking" signs must still be illuminated during surface movement, takeoffs, landings, and whenever the pilot deems necessary.

Passengers must follow crew instructions regarding these smoking rules.
