Flight time limitations and rest requirements: All certificate holders

This regulation establishes the framework for flight and duty time rules under Part 135 operations. It requires both the certificate holder and crewmember to ensure compliance with all applicable rest and duty time requirements (found in §§135.263-135.271) before accepting any flight assignment.

Key practical points:

  • Certificate holders cannot assign crewmembers to any duty during their required rest periods
  • Company-required transportation to or from an airport assignment does not count as rest time (though it's not duty time either)
  • If a flight is planned to finish within legal limits but runs over due to circumstances beyond anyone's control (like weather delays), the crewmember hasn't violated the regulation—what matters is whether the flight was expected to terminate on time at departure

This creates a "good faith" standard: plan flights legally, and unforeseeable delays won't create violations.
