US-FAA14 CFR 91.138
Temporary flight restrictions in national disaster areas in the State of Hawaii
Read the official ruleThis regulation allows the FAA to establish temporary flight restrictions (TFRs) in Hawaii's national disaster areas when the Governor requests protection for humanitarian reasons. The FAA issues a NOTAM defining the restricted area and how long it will last.
Once a NOTAM is active, you cannot fly in the designated area unless you meet specific exceptions:
- You have authorization from the official managing disaster relief operations
- You're carrying law enforcement officials
- You're conducting emergency operations or legitimate scientific activities
- You're carrying credentialed news media (must file a flight plan and comply with on-scene official's restrictions)
- You're operating under an ATC clearance or instruction
These restrictions last up to 90 days or until the disaster declaration ends, whichever comes first, though they can be terminated early or extended. Always check NOTAMs before flying in Hawaii during declared disasters.
