This regulation defines who must follow the rules in Subpart H, which covers special operations like flights between the U.S. and other countries.

The subpart generally applies to U.S.-registered aircraft operating outside the United States and foreign aircraft operating within the United States.

Section 91.702 (which addresses specific operational requirements) has broader reach—it applies to everyone aboard:

  • Any U.S.-registered civil aircraft operating outside the U.S.
  • Any aircraft operating outside the U.S. if its next destination or previous departure point was the U.S. and it then lands in the U.S.
  • Any aircraft that lands in the U.S. with a person still aboard, even if that landing wasn't originally scheduled

In practical terms, this means certain rules follow you and your passengers on international flights, particularly when your flight connects to or from the United States, ensuring consistent standards for operations touching U.S. airspace.
