Special flight authorization to exceed Mach 1
Read the official ruleThis regulation establishes that any civil aircraft operation exceeding Mach 1 (the speed of sound) requires a special flight authorization from the FAA. You cannot simply fly supersonic without prior approval.
To obtain authorization, you must apply to the FAA's Office of Environment and Energy, providing detailed information including the aircraft, flight area, timing, and crucially, how you'll ensure no measurable sonic boom reaches the surface outside your designated area. Authorizations are only granted for specific purposes like airworthiness testing, sonic boom research, or noise measurement—not for routine transportation.
The FAA must also complete environmental reviews before approving any supersonic flight. You must justify why the operation cannot be conducted over the ocean instead. Authorizations are temporary and can be suspended or terminated if environmental concerns arise. This regulation essentially prohibits civil supersonic flight over land unless you receive explicit FAA permission for testing or research purposes.
