US-FAA14 CFR 91.863
Transfers of Stage 2 airplanes with base level
Read the official ruleThis regulation governs how operators can transfer Stage 2 (noisier) airplanes along with their "base level"—the baseline number of Stage 2 aircraft an operator was allowed under the phase-out program.
Key rules:
- You can transfer Stage 2 airplanes with or without their base level allocation, but you cannot transfer base level by itself without the actual airplanes
- U.S. operators and foreign air carriers cannot share or swap base level with each other
- Transfers must be reported to the FAA within 10 days, including details about both parties, the aircraft involved, and the base level amount transferred
- If a transaction doesn't actually change the total number of Stage 2 airplanes either party operates, you cannot use it to show compliance with noise reduction requirements
This matters because it prevents operators from gaming the Stage 2 phase-out rules through paper transactions while ensuring legitimate transfers are properly documented.
