Phased compliance for new entrants

This regulation established a phase-in schedule for airlines that started operations between 1991 and 1994, allowing them to gradually transition to quieter Stage 3 aircraft rather than meeting noise requirements immediately.

For new U.S. carriers (Part 121) and foreign carriers (Part 129) starting service by December 31, 1994, the requirements were:

  • Before 1995: No Stage 3 aircraft required
  • After December 31, 1994: At least 25% Stage 3
  • After December 31, 1996: At least 50% Stage 3
  • After December 31, 1998: At least 75% Stage 3

When calculations result in fractions, airlines could round to continue operating the next whole number of louder Stage 2 aircraft.

Practical significance: This regulation is now historical. All deadlines have passed, and Stage 2 aircraft have been phased out of U.S. operations entirely under subsequent regulations. It's primarily relevant for understanding aviation noise policy history.
