Waivers from interim compliance requirements
Read the official ruleThis regulation allows U.S. operators and foreign air carriers to request temporary waivers from noise compliance deadlines under §§91.865 or 91.867. Applications must be filed at least 120 days before the compliance date you're seeking relief from.
To obtain a waiver, you must demonstrate it serves the public interest and show good faith efforts to comply. Your application should explain why meeting the deadline would be financially onerous, physically impossible, technologically infeasible, or would harm competition or service to small communities. Supporting documentation might include financial statements, current fleet composition, and aircraft delivery schedules.
The FAA publishes waiver requests in the Federal Register for public comment (typically at least 14 days). If granted, waivers are tailored to your specific circumstances but cannot extend beyond the next interim compliance date—meaning they provide temporary relief only, not permanent exemption from noise requirements.
