Policy and procedures
Read the official ruleThis regulation establishes that the FAA Administrator can grant waivers allowing aircraft operations that would otherwise violate certain rules in this subpart (Part 91, Subpart K, which covers fractional ownership programs). If the FAA determines an operation can be conducted safely despite deviating from a specific rule, they may issue a certificate of waiver permitting it.
To request a waiver, you must use the FAA's prescribed form and process, which can be submitted to any FAA office. This provides flexibility for operators who need relief from specific regulatory requirements due to unique operational circumstances.
Each waiver certificate specifies its own effective period and conditions—there's no standard duration. This means the waiver's scope, limitations, and expiration date are tailored to each specific situation. This process allows the FAA to accommodate special circumstances while maintaining safety oversight through case-by-case review.
