Operations over moving vehicles

This regulation sets the conditions for flying a small unmanned aircraft over people inside moving vehicles.

You must operate under one of the four operational categories (1, 2, 3, or 4) defined elsewhere in Part 107. For Categories 1-3, you have two options: either fly within a closed or restricted-access site where people in vehicles have been notified about drone operations, or avoid sustained flight directly over moving vehicles (brief overflights are acceptable).

Category 4 operations have different requirements—your drone must have an airworthiness certificate under Part 21 and operate within the limitations of its approved Flight Manual, which must permit flights over people in moving vehicles.

In practical terms, this means you can't simply fly over traffic on public roads under Categories 1-3 unless you're just crossing over briefly. Category 4 provides more flexibility but requires a certificated aircraft, which is uncommon for most commercial drone operations.
