ATC transponder equipment prohibition

This regulation prohibits drone operators from flying with an active ATC transponder unless they receive specific authorization from the FAA.

In practical terms, if your drone happens to have transponder equipment installed, you must keep it turned off during flight operations under Part 107. This is the opposite of manned aircraft requirements, where transponders are typically required in controlled airspace.

The prohibition exists because the air traffic control system is designed to track manned aircraft, and unauthorized drone transponder signals could create confusion or false traffic alerts for controllers and other pilots. Drones operate at lower altitudes and have different performance characteristics than the aircraft ATC expects to see on radar.

If you have a legitimate operational need to use a transponder on your drone—perhaps for a special research project or unique mission—you must obtain prior FAA authorization before activating it.
