US-FAA14 CFR 135.261

Applicability

Read the official rule

This regulation serves as a roadmap for the flight time and duty limitations that apply to Part 135 operations. It directs you to different sets of rules depending on your operation type.

Section 135.263 applies to everyone operating under Part 135. Section 135.265 applies to scheduled passenger operations (defined as at least five weekly round trips on a published, publicly available schedule) except those solely within Alaska. Any other Part 135 operator can voluntarily elect to follow 135.265 instead of the default rules.

Sections 135.267 and 135.269 apply to non-scheduled operations and Alaska-only operations, unless the operator chooses 135.265. Section 135.271 provides special rules for helicopter emergency medical services (HEMS). Section 135.273 covers flight attendant duty and rest requirements for all Part 135 operations.

Understanding which section applies to your operation is critical, as each prescribes different limitations on how long you can fly and work.
