Rules applicable to operations subject to this part

This regulation establishes which rules apply to Part 135 operations (on-demand and commuter air carriers).

Inside the US, operators must follow all applicable FAA regulations. Outside the US, they must follow either international standards (ICAO Annex 2) or the foreign country's rules, whichever applies, plus any more restrictive Part 61, 91, or 135 requirements that don't conflict with those rules.

For commuter operations requiring two pilots by type certification, operators must follow Part 121's training and qualification rules (subparts N and O) instead of certain Part 135 requirements. Other certificate holders may request FAA authorization to do the same.

The regulation also specifies that when Part 135 operators use Part 121 training standards, they must include certain upgrade training requirements but are exempt from leadership, command, and mentoring training requirements for single-pilot operations—since those crew resource management concepts don't apply when flying alone.
